Officials at the relevant dates
Mark Rutte, prime minister; Geoffrey van Leeuwen, minister for foreign trade and development cooperation, at the February 2024 decision. [S113]
The court order and appeal
On 12 February 2024 a Dutch appeals court ordered F-35 parts distribution to Israel stopped within seven days. Van Leeuwen decided to appeal in cassation. The government said it would implement the order meanwhile. [S113]
The policy defended
The government defended continued distribution and sought reversal of the order. That is a concrete record of the policy it sought to preserve. An appeal is not itself unlawful or proof that the government defied the order.
Earlier protective action
Reassess the relevant permission and halt affected distribution before being compelled by litigation. The record should identify what assessment ministers relied on and why that led them to defend the policy.
